Minister GÜL: Reducing the workload of judiciary is crucial 08.06.2018
Minister of Justice Gül participated in the opening of the 47th Ordinary Congress at the Union of Turkish Public Notaries.

Minister Gül noted that notariat has undertaken lots of work such as documentation of legal proceedings, storing the documents with respect to the proceedings regularly, resolving the litigations before they are sent to the judicial authorities and ensuring that the litigations already in the judiciary are resolved easily. He continued as follows:

"An impartial and independent notary system with strong professional competence will increase the quality of legal services. It will also reduce the number of litigations and contribute to the establishment of legal security."

LITIGATIONS ESTIMATED TO LAST THREE YEARS ARE SOLVED IN A FEW HOURS THROUGH RECONCILIATION

Mentioning that the growth and diversity in the population and increasing legal disputes numerically lead to an increase in the case number and workload of the courts, Gül indicated that their priority has always been ensuring that the judiciary productively functions to serve the people.

"Our main goal is to establish a sense of justice that provides confidence to all segments of the society. The compulsory mediation process in business disputes continues successfully. While 100.000 cases were filed from January to May 31 of the last year, the number of cases filed in labour courts during the same period of this year is about 24.000. In other words, about 75-80% of our citizens have preferred alternative dispute resolution methods instead of applying to court. Thus, disputes that would last for 2-3 years could have been concluded within a few hours. This is a significant data for our judicial system.

MORE THAN 3,5 MILLION VEHICLES HAVE BEEN TRANSFERED IN FRONT OF THE NOTARY PUBLIC

Noting that the actions taken by the public notaries reduce the workload of courts, Gül noted that steps taken in the past to extend the scope of duties and jurisdictions in public notary procedures have produced significant results.

Minister Gül said that authorising the notaries to issue the certificate of inheritance is more of a valuable development to satisfy the citizens as well as being an innovation regarding workload. "The sale and transfer of second hand vehicles have been undertaken by notaries electronically since 2010. Based on that successful innovation, other developments such as the conduct of car registries and the issue of registration certificates by notaries have also been successful and satisfied the citizens. 3,5 million registries have been recorded with this respect."

WE PLAN ON AUTHORIZING NOTARIES ON CONVEYANCE OF TITLE

Minister Gül indicated that efforts will continue to authorize the notaries with several ex parte proceedings. "We try to find new areas to authorize the notaries so that our citizens could solve their disputes out of court and the judicial workload can be reduced. We will continue to interoperate with the Union of Turkish Public Notaries."
